These Terms of Service ("Terms") govern your access to and use of the AppCast platform, dashboard, SDKs and embeddable widget (collectively, the "Service"). By creating an account or embedding AppCast in your application, you agree to these Terms on behalf of yourself and the organisation you represent.
1. The Service
AppCast provides software to generate, host, and embed vertical-video feeds inside our customers' web and mobile applications. AI generation features depend on third-party providers — we'll keep them available but cannot guarantee a specific provider remains the default.
2. Accounts
- You must be at least 18 to create an account.
- You are responsible for actions taken under your account.
- Use real information for signup; impersonation is grounds for termination.
- Keep credentials secure. Notify us at hello@appcaststudio.com of any unauthorised access.
3. Plans, fees, and AI credits
- Plans, included AI credits, and overage rates are listed on the pricing page at the time of subscription.
- Subscription fees are billed monthly or annually in advance and are non-refundable except where required by law.
- AI-credit overage is metered transparently and rolled onto your next invoice. We notify at 80% and 100% of monthly allowance.
- We may change pricing on 30 days' notice — changes apply at your next renewal.
4. Customer content
You retain ownership of all content (videos, scripts, images, brand assets, comments) you upload or generate ("Customer Content"). You grant AppCast a worldwide, royalty-free licence to host, process, and display Customer Content solely as needed to provide the Service to you and your end-users.
You represent that you own or have the right to use all Customer Content, and that it does not infringe third-party rights, contain unlawful material, or impersonate any person without consent. You are responsible for compliance with applicable advertising, banking, and consumer-protection laws when broadcasting through AppCast.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, deceptive, harmful, defamatory, or discriminatory content.
- Reverse-engineer, decompile, or attempt to circumvent security or access controls.
- Resell access to the Service without a written reseller agreement.
- Generate AI media that violates third-party intellectual property rights or any provider's acceptable-use policy.
- Interfere with other tenants' use of the Service.
6. Suspension and termination
We may suspend or terminate a tenant for material breach of these Terms, non-payment, prolonged abuse, or where required by law or by a regulator. Suspension blocks admin operations and renders the public feed temporarily unavailable (returning HTTP 410). Data is preserved through suspension for at least 30 days unless deletion is required by law.
You may cancel at any time. Cancellation takes effect at the end of the current billing period.
7. Service availability
We aim for high availability and publish status at status.appcaststudio.com. Enterprise customers get a written SLA. Other plans are provided on a best-efforts basis.
8. Third-party services
Some Service features (LLM-generated scripts, animated avatars, voice synthesis, OAuth, hosting, CDN, payments) depend on third-party providers. Your use of those features is subject to the third party's terms in addition to these Terms. We disclose our current sub-processor list on request.
9. Confidentiality
Each party agrees to keep the other's non-public information confidential and to use it only as needed to perform under these Terms. Each party may disclose Confidential Information to its employees and contractors who are bound by equivalent confidentiality obligations.
10. Intellectual property
AppCast retains all rights in the Service software, documentation, designs, and trademarks. Nothing in these Terms grants you any right to use AppCast trademarks except as permitted in our brand guidelines.
11. Warranties & disclaimers
The Service is provided "as is." To the maximum extent permitted by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement. AI-generated content may contain errors — review before publishing to your end-users.
12. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business. Each party's total aggregate liability arising out of or related to these Terms is limited to the fees paid by you to AppCast for the Service in the 12 months preceding the event giving rise to the claim.
13. Indemnification
You agree to defend and indemnify AppCast against any third-party claim arising from your Customer Content or your breach of these Terms. AppCast will defend you against any claim that the Service, as provided, infringes a third party's intellectual-property rights.
14. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Disputes will be resolved exclusively in the state or federal courts located in Wilmington, Delaware — except that either party may seek injunctive relief in any court of competent jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated to active customers by email at least 30 days before they take effect. Continuing to use the Service after the effective date constitutes acceptance.
